The pranksters' political speech isn't Constitutionally protected because it infringes on our IP.

A hoot since IP law is based squarely on Article I, Section 8, Clause 8 of the United States Constitution.

So they argued the Constitutional Right to Free Speech is trumped by the Constitutional Right of Copyright.
