[2] The interim orders sought by the petitioner were in the following terms: "(i)to suspend ad interim the purported agreement which is said by the United Kingdom government to have been concluded between it and the European Union and the United Kingdom government, on the basis that this agreement provides for Northern Ireland to form part of a separate customs territory to Great Britain; and

(ii)for interdict ad interim against Ministers of the Crown in right of the United Kingdom including the Prime Minster (and anybody acting on their behalf or at their request) from entering into arrangements under which Northern Ireland is to form part of a separate customs territory to Great Britain".

[26] For all these reasons, I conclude that the petitioner's applications for interim orders are misconceived and unjustified.  They have no or at best a weak prima facie case. The balance of convenience comes down firmly on the side of refusing to make the orders. I shall accordingly refuse the petitioner's motion insofar as it seeks interim orders.

[27] I shall order intimation and service of the petition and appoint answers to be lodged within 7 days.

Court is not poised to grant interdict, recognizing

The agreement would have been declared void and there would be nothing that could lawfully be laid before Parliament. The remedies soughtwould amount to a manifest interference with the proper processes and procedures of Parliament and would prevent legitimate debate in Parliament about the terms of the Withdrawal Agreement.
Besides MPs throwing "all Ireland" under the bus, because they cannot be shifted to depose HRM BoJo unless EU grants another extension (ending when hell freezes)

(1) Cherry (counsel) returns Mon, 21 Oct to amend pleading, answer Ct questions; and
(2) Cherry move in HoC for Bercow signature on the SCHEDULE FORM LETTER grasps at at a straw.

You know, I have routinely posted a link to the legislation AND judgments which are silent on the issue of SCHEDULE FORM LETTER. They were all about prorogation, were they not? Yes.

I predicted he would send it (obey the law). What I could not predict was the stupidity of MPs, who had used the insane tabloids to forbid HRM BoJo a mysterious "second letter", sudden demand for a "second letter" --not stipulated in the "Benn act", upposedly arguing for an extension.

There is a possibility that the EU could grant a month-long "technical extension" until the end of November [!] in order to maintain pressure on the UK to rubber-stamp the deal.

Now they've got THREE < wipes tears > attesting to HoC's deliberate intransigence and intention to circumvent the one purpose of A.50(3) period. That is approve the WITHDRAWAL agreement(s) between PM(s) and EU Council.

When MPs get to UK courts are they going to argue that HRM BoJo has a duty to lie for the HoC?

Tabloid explanation for Teh Letwin Amendment has let out the otherwise inexplicable need for HoC pass legislation conforming with the Withdrawal Act before ratification of the Withdrawal Agreement.

On what planet does any legislature do that, enact a treaty before ratifying it? Certainly not the U.S.A. ever. Maybe ...SUDAN?

Wellllllllll, it appears in the pleadings for interdiction in the Scottish Court of Sessions that a Mr. O'Neil claims just that among other things. HoC must first repeal or amend Section 55 of Taxation (Cross-Border Trade) Act 2018 to permit "duty free" NI.

I have indicated this several times in the gentlest terms. EU cause of action to terminate consideration of A.50(3) has appeared every time HoC rejected the WA and A.50 revoke acts over the prior 7 months. UK "bad faith" and incompetence in execution of its duties to TEU is ... complete.

So.

If EU wants to carry that water in perpetuity, so be it.
