Executive orders, presidential memoranda, and proclamations are used extensively by Presidents to achieve policy goals, set uniform standards for managing the executive branch, or outline a policy view intended to influence the behavior of private citizens. The U.S. Constitution does not define these presidential instruments and does not explicitly vest the President with the authority to issue them. Nonetheless, such orders are accepted as an inherent aspect of presidential power. Moreover, if they are based on appropriate authority, they have the force and effect of law. This report discusses the nature of these written instruments, executive orders in particular, with a focus on the scope of presidential authority to execute such instruments, as well as judicial and congressional responses to their issuance.

The nationwide injunction from District Judge George Daniels in New York City halts the administration's attempt to REDEFINE what constitutes a "public charge," or immigrants who are, or who might become, OVERLY DEPENDENT on government assistance.

The scheduled enactment [sic] next week of the rule comes as the Trump administration last Friday announced another rule, a proclamation effective Nov. 3 that bars immigrants from coming to the United States unless they will be covered by health insurance within 30 days of entering or have the financial wherewithal to pay for any medical costs.

It's an ironic stance from a government that has repeatedly attacked the Affordable Care Act, which helps provide health insurance for millions of U.S. citizens.

Census Bureau seeks state data, including citizenship info

morons, Your turn is coming. REAL ID verification and replacement has been rolling since 2018. It was endorsed by AAMVA from the beginning. It's been litigated by "privacy orgs" since at least 2007, when the US visa regs first changed US passport controls. I WAS SUMMONED June 2019 by the state to appear with three (3) proofs of residence and nativity or lose my license. The motor vehicle dept scanned each piece into a digital record.
The bureau also is seeking more state records on individual recipients of public [assistance] programs. A new request published last month in the Federal Register said the records would be used for the 2020 Census and other research, and they're needed to "improve efficiency and accuracy in our data collections, and to improve measures of the population and economy."
States already share records on food public assistance and other programs to help the bureau track traditionally ["]undercounted["] populations and pinpoint vacant houses. The states' administrative records could cover a host of topics attributes, including citizenship, said John Thompson, a former Census Bureau director in the Obama administration.

California DMV data BREACH exposed THOUSANDS of drivers' information, agency says
A data breach at the California Department of Motor Vehicles may have exposed some drivers' Social Security number information to seven government ENTITIES, according to the DMV. The breach affects about 3,200 individuals over at least the last four years, the agency said in a statement. The DMV insists it was not hacked and information was not shared with private individuals or entities.

The information was improperly disclosed through the Government Requester Code Account Program, which allows government agencies to access information on file with the DMV and is "permitted only for limited purposes under state and federal law."
18 USC § 2721 (b) permits 14 different types of "disclosure", 11 without "consent" of the individual "to whom the information pertains". Then there's Real ID ahh disclosure purposes.
The DMV said it has "implemented several additional layers of review" for any new requester that seeks to access any social security information.

NY Law Giving Licenses to Noncitizens Upheld
The Green Light Law allows people to apply for driver's licenses without handing over a social security number, allowing the use of foreign identification documents. The law also expressly states that people do not need to prove they're legally present in the U.S. in order to get driver's licenses, and that the DMV cannot question them about their immigration status.

Russia or another country may try to push the census off course, they say, and Facebook and other companies should be prepared.
"We're extending the current set of policies we have around voter suppression to a new census suppression policy too," Zuckerberg said. "We recognize this is important and rises above normal hoaxes or misinformation where we may allow someone to post it and mark it as potentially false by independent fact-checkers."
"The biggest thing about our partners already, though, is their ability to be a set of eyes and ears where the census is not, and in some places cannot be, to try to catch that misinformation and disinformation before it even gets to the level of a few social media posts," Ahmad said.
Arturo Vargas, CEO of the National Association of Latino Elected Officials Education Fund, a census outreach partner, said Trump's unsuccessful effort to add a citizenship question to the 2020 census may spill out online during next year's count.

"I'm expecting the president to use his Twitter platform to say who should be counted and who should not be counted," Vargas told CQ Roll Call. "I don't know if (census officials) are going to be prepared to handle that."

"When you undercount people for the census, they end up losing in that community dollars that could go toward services that can help remediate poverty," said state Rep. David Bowen, a Milwaukee Democrat co-sponsoring legislation to end what critics call prison gerrymandering.

Democrats argue the system shifts resources from traditionally liberal urban centers -- home to many inmates who are disproportionately black and Hispanic -- to rural, white, Republican-leaning areas where prisons are usually located.
