World Court to hold preliminary hearing Monday, with Nicaragua seeking to halt Berlin's military aid to Israel; Germany rejects accusations it is in breach of Genocide Convention

THE HAGUE, The Netherlands -- Preliminary hearings are set to open Monday at the United Nations' top court in a case that seeks an end to German military and other aid to Israel, based on claims that Berlin is "facilitating" acts of genocide and breaches of international law in the Israel-Hamas war in Gaza.

Israel strongly denies its military campaign amounts to breaches of the Genocide Convention.

"We are calm and we will set out our legal position in court," German Foreign Ministry spokesperson Sebastian Fischer said ahead of the hearings.

"We reject Nicaragua's accusations," Fischer told reporters in Berlin on Friday. "Germany has breached neither the genocide convention nor international humanitarian law, and we will set this out in detail before the International Court of Justice."

The deputy prime minister has told the BBC he believes it is still legal for the UK to continue to sell arms to Israel.

There have been calls for the UK to stop arming Israel after seven aid workers were killed in Gaza this week.

Oliver Dowden suggested the UK would stop supplying weapons to Israel if it was found to be in breach of international law. But Mr Dowden insisted Israel was conducting a "legitimate" war.

The German state is taking extraordinary measures to clamp down on pro-Palestinian activism, including arresting activists in their homes in the middle of the night.

The German government has not only provided wide-ranging political and diplomatic support for Israel, but has also fast-tracked arms exports to facilitate the­­­ Israeli slaughter of Palestinian civilians.

Anti-Palestinianism as a state policy

The marginalisation of Palestinians within German society and the suppression of pro-Palestinian activism are not a new phenomenon in Germany. Long before October 7, the anti-Palestinian tactics of the German authorities were already escalating. Protests were banned, pro-Palestinian voices, including those of Jewish activists, were silenced, and cultural events and award ceremonies were cancelled.

It is thus unsurprising that the crackdown on protests and police violence have increased in recent weeks. Numerous pro-Palestinian demonstrations have been banned, sometimes only minutes before they were supposed to begin, or allowed to take place only with heavy police presence. Bureaucrats have cited threats to public safety and potential display of anti-Semitism as reasons for the bans.

Top UN Court to Hold Hearings after Germany Accused of Facilitating Israel's Gaza Conflict

Preliminary hearings open Monday at the United Nations' top court in a case that seeks an end of German military and other aid to Israel, based on claims that Berlin is "facilitating" acts of genocide and breaches of international law in the Israel-Hamas war in Gaza.

While the case brought by Nicaragua centers on Germany, it indirectly takes aim at Israel's military campaign in Gaza.

"We are calm and we will set out our legal position in court," German Foreign Ministry spokesperson Sebastian Fischer said ahead of the hearings.

"We reject Nicaragua's accusations," Fischer told reporters in Berlin on Friday. "Germany has breached neither the genocide convention nor international humanitarian law, and we will set this out in detail before the International Court of Justice."

Nicaragua has asked the court to hand down preliminary orders known as provisional measures, including that Germany "immediately suspend its aid to Israel, in particular its military assistance including military equipment in so far as this aid may be used in the violation of the Genocide Convention" and international law.

The court will likely take weeks to deliver its preliminary decision and Nicaragua's case will likely drag on for years.

Monday's hearing at the world court comes amid growing calls for allies to stop supplying arms to Israel as its six-month campaign continues to lay waste to Gaza.

On Friday, the UN's top human rights body called on countries to stop selling or shipping weapons to Israel. The United States and Germany opposed the resolution.

ICJ hears Nicaragua's case against Germany over Israel's war on Gaza

The International Court of Justice (ICJ) begins two days of hearings to consider Nicaragua's request that emergency measures be imposed on Germany over its support for Israel's war on Gaza.

Pellet concludes legal remarks

France's Alain Pellet has finished outlining Nicaragua's legal case against Germany, and Nicaragua's Ambassador Gomez is now delivering the delegation's concluding remarks.

"Professor Pellet has just explained how Germany's conduct in relation to the ongoing situation in Palestine" does not meet its international law obligations, said Gomez. The case against Germany falls under two broad headings, he said:

  • Germany's responsibility for its failure to take action required by international law to prevent genocide and serious breaches of international humanitarian law.
  • Germany's responsibility for its actions or omissions that have facilitated and continue to facilitate the commission of genocide and serious breaches of international humanitarian law.

Germany's arms transfers to Israel show `complicity' in genocide

Pellet has pointed to Article 3 under the UN's Genocide Convention, which outlines "complicity in genocide" as a punishable act.

"Germany was aware and continues to be aware of the risk of the weapons they are furnishing could be used by Israel to commit genocide against the Palestinians," said Pellet.

"It is extremely urgent that Germany suspend its aid they are supplying to Israel to this end. This aid and assistance are straight from the definition of `complicity' set out in Article 3," he added.

Nicaragua Sues Germany at Int'l Court of Justice to Halt Weapons to a "Genocidal" Israel | Informed Comment |

Nicaragua's opposition online newspaper, La Prensa, reported that proceedings began at the International Court of Justice in Managua's complaint against Germany for abetting Israeli genocide against the Palestinians of Gaza with its weapons shipments. Nearly half of arms shipments to Israel during the past six months have come from Germany, and it is second only to the United States as an arms supplier to Tel Aviv. Germany has increased arms transfers to Israel by a factor of ten.

Carlos José Argüello Gómez, Nicaragua's ambassador to The Hague, said, "Germany seems unable to differentiate between self-defense and genocide. Germany is not fulfilling its own obligation to prevent genocide or ensure respect for international humanitarian law."

The ambassador pointed to a German double standard. Merely on Israel's say-so, Berlin  halted financing for the UN Relief and Works Agency (UNRWA), which is a lifeline for hundreds of thousands of Palestinian refugees in Gaza. But the German government has ignored much more credible allegations that Israel itself is committing genocide in Gaza.

Israel's charge that UNRWA was riddled with Hamas militants was fact-free and lacking in any sound evidence, and most of the countries that suspended support for UNRWA after Netanyahu's scurrilous accusations have now restored their donations.

Argüello said, "The Palestinian people are being subjected to one of the most destructive military actions in modern history."

He said that without the unstinting support of countries such as Germany, Israel would not be able to act with impunity.

The ambassador acknowledged that Germany recognizes a special obligation to assist the Jewish people because the National Socialist government of Germany genocided them during World War II. He observed, "that is an understandable and commendable policy if it were addressed to the Jewish people, but the State of Israel, and particularly its current Government, should not be confused and equated with the Jewish people."

Argüello has a point. The policies of the current extremist Israeli government are often being dictated by people like Bezalel Smotrich and Itamar Ben-Gvir, who are plausibly characterized as fascists.

For Germany to be compliant with demands of Smotrich and Ben-Gvir is to compound the sins of the Holocaust, not to alleviate them. You can't make up for mass murder committed by fascists by supporting fascists committing mass murder.
