Two Irish citizens residing in Berlin have been already issued with deportation orders following their participation in pro-Palestinian demonstrations, in a move they have described as a politically motivated crackdown on dissent.

Shane O'Brien and Roberta Murray were informed by the Berlin authorities that they must leave Germany by April 21st. The state of Berlin, which oversees immigration enforcement, has also issued deportation orders to a Polish citizen and a US national.

The Irish Department of Foreign Affairs and Trade has acknowledged the reports and stated that it stands ready to offer consular assistance to those affected. However, no further details have been provided on whether diplomatic intervention will be sought to prevent the expulsions.

The deportation orders, issued under German migration law, were made amid political pressure and over internal objections from the head of the state of Berlin's immigration agency. The internal strife arose because three of those targeted for deportation are citizens of European Union member states who normally enjoy freedom of movement between E.U. countries.

The orders -- issued by the state of Berlin, whose Senate administration oversees immigration enforcement -- are set to take effect in less than a month. None of the four has been convicted of any crimes.

According to the four individuals, the deportation orders were initially rejected by the Berlin immigration office. However, they claim that the decision was subsequently overturned under pressure from the Berlin interior department, despite none of them having any criminal record.

The group alleges that they have been accused of anti-Semitism and of supporting terrorist organisations, specifically Hamas. In a joint statement, they denounced the charges as unfounded, stating that their removal from Germany constitutes a "political act" aimed at silencing and intimidating the pro-Palestinian movement.

Germany is moving to deport four foreign residents of Berlin over their alleged activity at pro-Palestinian protests, in a move that appears likely to test a foundational law enacted in the wake of the Holocaust.

German immigration authorities ordered this group's expulsion based on separate allegations tied to pro-Palestinian demonstrations, including a sit-in at the Berlin central train station, a road blockade and the occupation of a building at the Free University, according to information obtained by the left-wing news organization The Intercept.

The deportation orders say that two of the protesters called a police officer "fascist" -- insulting an officer is illegal in Germany -- and three demonstrated with groups that chanted "from the river to the sea, Palestine will be free," a slogan the country outlawed last year as antisemitic. All of them are also accused of "indirectly" supporting Hamas and pro-Hamas organizations in Europe.

They have been given a deadline of April 21 to leave Germany or be forcibly deported.

None of them has been convicted of a crime. A conviction is not required for deportation under German law, but authorities are still expected to provide justifications proportional to the punishment.

As part of this reasoning, three of the deportation orders reference Germany's "Staatsräson," or "reason of state."

Irish Travel Advice to War Zone Israel

Please be advised that as of 1 January 2025 those entering Israel from visa-exempt countries (including Ireland) must be in possession of a valid Electronic Travel Authorisation to Israel (ETA-IL). For further guidance, and to apply, see https://israel-entry.piba.gov.il/.

Irish citizens currently in Israel or Palestine who have not already done so, are asked to register on the Department’s Citizens Registration platform here.

Irish citizens in Israel are strongly advised not to travel to border areas with Lebanon, as directed by local authorities. The area remains a closed military zone and entry into the area is prohibited. Further incidents can occur without notice and there is potential for intense escalation; extreme caution is advised. Travel should also be avoided north of Acre, north of Route 85. In the occupied Golan Heights, travel should be avoided north of Route 87 and within 500m of the ’Alpha Line’ or east of Highway 98.

We strongly advise against all travel to the Gaza Strip, and to all border areas between the Gaza Strip and Israel, as directed by local authorities. Irish citizens in the Gaza Strip are advised to exercise extreme caution, and register their presence immediately by contacting the Embassy of Ireland in Tel Aviv.

Due to the volatile security situation, we currently advise against all travel to the occupied West Bank, with the exception of East Jerusalem, where we advise against non-essential travel.

Israel’s Defence Minister says Ireland’s “hypocrisy will be exposed” if the country refuses to take Palestinian refugees. A Cork TD has rejected this claim, replying that Ireland does not have “any obligation whatsoever."

Irish MEPs ask EU to assess legality of German plan to deport of Irish Palestine activists

Seven Irish members European parliament from different parties have written to the European Commission seeking that it assess the legality of German authorities threatening two Irish pro-Palestinian protesters with deportation orders.

Sinn Féin's Lynn Boylan, Fine Gael's Maria Walsh, Labour's Aodhán Ó Ríordáin and Fianna Fáil's Billy Kelleher, Barry Andrews, Barry Cowen and Cynthia Ní Murchú wrote to the Commission today on the issue.

Authorities in Germany were reportedly seeking to deport four people, including Irish citizens Roberta Murray (31) and Shane O'Brien (29), despite not having been convicted of a crime.

In their letter the MEPs outline that three EU nationals - two Irish and one Pole - were reportedly ordered to leave Germany over their participation in the protests. The Journal reported this month that Irish officials were aware of the incident.

"Freedom of expression and freedom of assembly are both guaranteed in the Charter of Fundamental Rights of the EU and in the European Convention of Human Rights," the MEPs write.
